Revitalizing H-1B Visas: US Department Introduces Pilot Programme for Renewals




In a move aimed at reinvigorating the H-1B visa renewal process, the U.S. Department of State is launching a pilot programme designed to assess its technical and operational capabilities in handling domestic visa renewals. This initiative, set to roll out in phases, will initially accommodate 20,000 applicants and is exclusively open to individuals from India and Canada.

H-1B Visa Pilot Programme: Important Dates

The application window for the H-1B pilot programme is scheduled to open on January 29, 2024, and will run until April 1, 2024. Prospective applicants are encouraged to submit their applications online within this three-month period. Additionally, the Department has set a deadline of midnight on April 15, 2024, for the submission of written comments and related materials.

The Department plans to release approximately 4,000 application slots for H-1B visa renewals each week. These slots will be made available on specific dates: January 29, February 5, February 12, February 19, and February 26.

H-1B Visa Pilot Programme: Eligibility Criteria

Applicants must meet the following criteria to be eligible for the H-1B visa pilot programme:

1.    Only H-1B visa renewals will be processed during the pilot phase; other visa types are not included.

2.    The H-1B visa to be renewed must have been issued by Mission Canada between January 1, 2020, and April 1, 2023, or by Mission India from February 1, 2021, to September 30, 2021.

3.    Eligibility for a waiver of the in-person interview is required.

4.    Applicants must have previously submitted ten fingerprints to the Department for a past visa application.

5.    Applicants should not be subject to a nonimmigrant visa issuance fee, also known as a reciprocity fee.

6.    The prior visa must not have a 'clearance received' annotation.

7.    Applicants cannot have a visa ineligibility that requires a waiver for issuance.

8.    Applicants must have an approved and unexpired H-1B petition.

9.    The applicant's most recent admission to the U.S. must have been in H-1B status.

10. Applicants must be currently maintaining H-1B status in the United States.

11. The period of authorized admission in H-1B status should not have expired.

12. Applicants must intend to reenter the U.S. in H-1B status after a temporary period abroad.

H-1B Visa Pilot Programme: Application Process

Applicants are required to pay a non-refundable and non-transferable Machine Readable Visa (MRV) fee of $205 (Rs 17,072) through the online portal.
